Terms & Conditions for Design Submission.
By selecting "I Agree" in the design submission page and in consideration of Bagstab.net evaluating your Design (hereinafter the "Design") for the possible use on bags and other future uses (the "Items"), you agree to the following terms and conditions ("Design Submission Terms and Conditions"):
If and only If your Design is selected for use by Bagstab.net, you acknowledge that you as the creator of the Design, grant to Bagstab, LLC and its subsidiaries and affiliates (hereinafter collectively "Bagstab.net") the permission to sell and use (marketing, advertisement, demonstrations and other use) your Design for one length of a time in the Bagstab Store and other Bagstab Outlets. The length of this one period of time is solely in Bagstab.net's discretion. Even though such permission is granted by the owner of the rights (creator of the art/design), in the event that the artist/designer deems that the use or placement of his/her art as offensive or for reasonably reasons inappropriate, Bagstab will modify or remove the said use or placement of the art/design if requested by the creator of the specific art/design. If after Bagstab so choose to place your Design back for sale or use after the initial length of time, Bagstab will make that request to the creator of the Design.
Because you as the designer of the selected art/design still own the rights to the intellectual property, you can use it elsewhere at the same time it is sold/used at Bagstab. We take no responsibility if our sales or use of the art/design infringes on another unknown agreement that the artist/designer may have with another party. Bagstab is held harmless in such a case. Bagstab is also not responsible for any of the artist/designers' tax liabilities generated from the royalties from Bagstab. Bagstab also reserves the right to end the relationship or use or sale of any artist/designer's submission at anytime.
You acknowledge that Bagstab.net reserves the right to decline to select a Design for consideration for any reason, including poor design, as further explained in the "Reasons for Declining a submission" section of the Bagstab.net website, which are subject to change at any time.
The Bagstab Royalty Awards
In return for your permission to sell and use your Design if selected for use by Bagstab.net, you as the creator will receive every 15th - 17th of the month royalty disbursements based on the previous month's gross sales of your design. Payments will be made via Paypal (fees incurred if any are not Bagstab's responsibility). Here is the breakdown of the royalty:

Bagstab.net reserves the right to change these payment terms at any time, by posting them on the Bagstab.net website, and changes will be effective upon posting. Bagstab also reserves the right to remove or feature any designs in the Bagstab Store. You alone will be responsible for the payment of any tax that arises as a result of receiving payment from Bagstab.net . Royalty Payment will be sent within sixty (60) days after every month of sales if there is a sale. When selected, we may request from you high resolution production art of the selected design. If the hi-resolution artwork is not deemed suitable for print as determined by Bagstab.net , Bagstab.net will notify you of the reason(s) for its determination by email and will make a good-faith effort to assist you in presenting a suitable hi-resolution format.
Participants, who in the opinion of Bagstab.net , do not comply with these Terms and Conditions for design submission, or for any other reason at Bagstab.net's sole discretion, can at any time be excluded from consideration without notice.
The decisions of Bagstab.net are final and binding.
Reasons for declining a submission
Declined (1): Submission Needs Work / Inappropriate for Bagstab
Thank you for your submission but unfortunately it didn't make it this time around. We want every design submitted to Bagstab to have the best possible chance at being chosen for print. Sometimes submissions are declined because we feel the idea could use a little more something. The objective to find the best design suited for the bags and also most acceptable. That is why we recommend users to get feedback and comments from the forum where everyone is there before uploading for vote to print. Link to the forums, check it out. Declined (2): Artwork is not printable for technical reasons
Although we continually work hard to find the best way to transfer your artwork to the bags, there are limitations. Most of the time it is limitations that we won't know until the printing department tries it. As we gain more experience, we will be able to narrow down the limitations. These may include artwork being too intricate, too many colors or somehow the end result artwork on the bag just doesn't match. Some times it could also be that the art we have is too blurry or low in resolution.
Declined (3): Unnecessary Use of Multiple Colors
We all need to be realistic about what is and is not necessary for a design. Not only does it look too busy but once printed on the bags it may be worst. If we strongly feel that the number of unique colors used in a submission does not add anything to the design, it will be declined. The use of the forum as a pre-submission critique will help avoid this problem.
Declined (4): Artwork Not Submitted On Template Kit
We require that designs are submitted on our template so we know the intended placement and aspect ratio. This may require you to edit the art to fit the template properly. A submission will be declined if the design submitted was not on one our templates or not fitted to it.
Declined (5): Design Is Too Large or Too small For Print
A submission will be declined if it is too large or too small for printing. In the template kits, we have specified the area of art printing. Anything bigger will be declined. As far as being too small, we will judge by how necessary is its size and also judged by the printing department.
Declined (6): Artwork Contains Copyrighted Material
A submission will be declined if it contains copyrighted material even celebrity likenesses, trademarks, or parody. We try to be more specific as we go and any updates we will post it for all to see.
Declined (7): Submission Deemed Inappropriate
A submission can be declined if it contains material or themes that make our kids feel uneasy. Let's keep bagstab Pg-13.
Declined (8): Duplicate Submission
No go for duplicates. All resubmissions of a design even if there has been some changes or revisions will not be accepted. Even if the modifications are based on community comments about the original design, we still treat it as a duplicate. Again, we ask that you use the forums to gain feedback before officially submitting. If we do choose to print the original design a declined duplicate submission is based off of, you will be able to provide us with the updated version.
Declined (9): Artwork Contains Only Text
A submission can be declined if it contains only text or mostly text. Artwork with text as an element is ok, but a text-based design is far too simple to be considered for approval.
Declined (10): Invalid file format or poor image quality
if we are unable to open either the illustrator or photoshop file then we will have to decline. Please be sure to stay true to the format that is in the kit. A submission will also be declined if the quality of your image is too poor (pixilated or blurry). This is also a common mistake. Make sure to save your work at a resolution of at least 150dpi. If it is something that is easily remedied by you after we declined it, then we will accept a resubmission.
